Personal Injury:
Personal injury refers to an area of the law that seeks to protect
victims who are harmed by the negligence of another person or
entity. Negligence, in turn, is defined as the failure to act
with the prudence that a reasonable person, under the same circumstances
would have exercised.
Personal injuries can be sudden, devastating, and tragic events
which have an enormous impact on the lives of the individuals
who experience them. The long term implications of many personal
injuries often do not surface or become apparent until many years
after the initial occurrence. Because these claims include medical
care, earning capacity and quality of life, they can become complex
legal matters.
The lawyers at Iamele & Iamele, L.L.P. are prepared to investigate

Malpractice:
Medical Malpractice is an act by a physician, hospital or any other
health-care provider that has been performed negligently. In essence
a malpractice case is an allegation that a professional has breached
a standard of care that is recognized by other health care professionals
in the community and thus acted improperly or failed to act properly.
Contrary to news media reports, surprisingly few malpractice claims
are actually filed. Only 2% of people injured by the negligence
of medical professional seek compensation through a lawsuit. One
reason is that medical malpractice cases are extremely expensive
and time intensive. Medical Malpractice Insurance exists
for a reason. If a caregiver has harmed you or a loved one, you
may be entitled to compensation. Because it is often difficult
to determine whether malpractice has occurred, early intervention
is essential in such a case. The lawyers at Iamele & Iamele,
L.L.P. will ensure that your potential malpractice case is reviewed
by the proper expert and is given the individualized attention
that your case deserves. Our attorneys represent victims of medical

Wrongful Death:
The purpose of wrongful death law is to compensate for harm to
a person resulting in death. A wrongful death lawsuit allows the
surviving dependents or beneficiaries, such as spouse, child,
or dependent parent to receive monetary damages as a result of
the defendant’s negligent conduct. Under Maryland law surviving
family members may be compensated for both economic and non-economic
damages. Economic damages may include loss of future income and
financial support, or even placing a value on the loss of different
household services the family member provided. Non-economic damages
may include the loss of love, care, comfort, supervision, and
guidance.
Determining the amount of compensation that a family is entitled
to following the death of a relative requires experience. The
handling of these claims also necessitates and understanding of
the tremendous strain that family members undergo after the loss
of loved one. The lawyers at Iamele & Iamele, L.L.P. have
the ability to sort out the details of a wrongful death claim
in the context of turmoil surrounding such a case.

Police Misconduct:
Although most police officers police officers behave as valued
public servants, there are a few who abuse their power, violate
their oath as peace officers and trounce the rights of the public.
Police misconduct is not merely a problem, it is illegal. Perhaps
the best known example of misconduct is brutality. Police misconduct
also includes improper search and seizure, harassment and racism
in law enforcement. Victims of police misconduct can be injured,
wrongfully convicted of crimes, wrongfully incarcerated and may
face social stigmatization.
Citizens are protected against police misconduct by both the
Federal Constitution and the Maryland Declaration of Rights. Moreover,
the law allows for victims of police misconduct to sue individual
police officers for the deprivation of their rights, as well as,
monetary damages for the injuries they have suffered.
Because cases against police officers are often difficult to
win, many lawyers refuse to accept this type of case. The lawyers
at Iamele & Iamele, L.L.P., however, believe that these cases
are important and integral to out democracy. The firm has investigated
and successfully litigated numerous police misconduct cases resulting
in multi-million dollar trial verdicts and out of court settlements.

police misconduct cases to Iamele & Iamele, L.L.P.

Crime Victim Litigation:
The consequences of crime frequently extend far beyond the criminal
act. Victims often find themselves confronted with expenses for
medical procedures, physical rehabilitation, counseling and lost
wages. Crime victims and their families are often unaware of their
rights to seek civil redress. Regardless of the outcome of the
criminal prosecution, or even if there was no prosecution, crime
victims can file civil lawsuits against offenders and other responsible
parties.
The civil system, unlike the criminal justice system, does not
attempt to determine the guilt or innocence of an offender. Rather,
civil courts determine whether an offender or a third party is
liable for injuries sustained by the victim as a result of the
criminal event. Moreover, in the civil system liability must be
proven by a “preponderance of the evidence” which
is substantially less than the “proof beyond a reasonable
doubt” standard utilized in criminal cases. Where an offender
is found to be civilly liable, courts may order the payment of
monetary damages to victims. Although such awards can never fully
compensate the victim of trauma or replace the loss of a loved
one, they can be a valuable resource to help crime victims rebuild
their lives.
Examples of criminal conduct that can rise to a civil suit include:
- “Sexual Abuse” - sexual impropriety including rape
and sexual assault and characterized by the victim’s lack
of or inability to consent.
- “Homicide ” – a death caused by another person
which occurs without justification or excuse, including murder,
manslaughter and vehicular homicide.
- “Assault” – any intentional physical contact
that offends a victim.
- “Kidnapping” – holding a victim against his
or her will for any amount of time.
In some crime victim cases a “third-party” may also
be held liable. These third parties are typically included in
case where they have created or contributed to the circumstances
giving rise to the criminal event. Examples of potential third
parties include:
- Hotels, colleges, shopping malls and apartment complexes may be
found liable to a criminal victim for failing to provide adequate
security.
- Child-care centers, schools, and churches that fail to adequately
check the background of their employees or respond to allegations
of abuse.
- Companies providing home services that fail to adequately check
the background of their employees or safeguard their customers.

civil cases on behalf of criminal victims. They also have the
